Art. 1. These General Terms and Conditions determine the order, terms and conditions of the remote contract between "Ecofilter.store", represented by Kangen OOD, with EIK 202183303 on the one hand, and the person who has submitted electronically on the website www.ecofilter.store agreement to the terms of purchase, hereinafter referred to as "Client" for short, on the other, and all other relationships and disputes arising from this contract.

Definitions

Art. 2. In the interpretation and application of these General Terms and Conditions, the following terms and expressions have the following meaning:

A website is a designated place on the global Internet network, accessible through its unified address (URL) under the HTTP, HTTPS or other standardized protocol and containing files, programs, text, sound, picture, image or other materials and resources.
A user of an internet page or site is any person who has entered the electronic address or reached the internet page or site through redirection from another internet site and agrees, if there is an interest, to buy and sell goods and/or services electronically;

"E-store Ecofilter.store" is an e-commerce website - a virtual information resource on the Internet for the sale and delivery of the goods published on it.

"IP Address" ("IP Address") is a unique identification number associating the Customer's computer, Internet page or resource in a way that allows their location in the global Internet network.

Browser - a computer program providing the ability to transfer, process and visualize data using various types of data transfer protocols.

Malicious actions are actions or inactions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, sending unsolicited mail (unsolicited commercial messages, SPAM), gaining access to resources with foreign rights and passwords, exploiting flaws in systems for personal gain or information extraction (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending "Trojan horses" or causing the installation of viruses, or remote control systems, disrupting the normal work of other Internet users and associated networks, performing any actions that can be qualified as a crime or an administrative offense under Bulgarian legislation or other applicable law.

Consent

Art. 3. Any person may use the resources and services provided by the "e-store www.ecofilter.store" subject to compliance with these General Terms and Conditions.

The publication of these General Terms and Conditions and the description and prices of the goods in the "e-store www.ecofilter.store" is a public invitation within the meaning of Art. 290, para. 1 of the Commercial Law to make an application for purchase in accordance with them in the manner described in the next paragraph.

By pressing the virtual button "Send" after the text "I agree to the general terms and conditions for the use of the site", the Customer makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, by which he declares that he is familiar with these General Terms and Conditions and accepts to purchase the goods of his choice under the current conditions.

Art. 4. Each individual purchase application sent by the Customer to Ecofilter.store is considered separately agreed upon.

Individual individual contracts are considered concluded with the authorization of the corresponding payment.

If an incorrect address and/or phone number is specified in the purchase application for Ecofilter.store, there is no obligation to fulfill the order.

It is assumed that every person who has paid the price of a product requested by him for purchase has expressed his will to be bound by the text of these General Terms and Conditions.

Publishing information about goods on Ecofilter.store

Art. 5. Ecofilter.store publishes on https://ecofilter.store a short description and price for each of the goods that can be purchased through the "e-store www.ecofilter.store".

Eecofilter.store is not responsible for untruthfulness of the product information provided by the manufacturer.

Prices

Art. 6. All prices published on the website www.ecofilter.store are in Bulgarian leva including VAT.

The indicated prices of the individual goods are for a single quantity or a single package and do not include delivery costs.

The price payable by the Customer is the price indicated in the invitation to purchase the goods at the time of making the application for the purchase of the same in the manner described in Art. 3, para. 3 of these general conditions.

Time and methods of payment

Art. 7. The price under Art. 6 and shipping costs can be paid in any of the following ways:
         in cash upon receipt of the goods (cash on delivery);
         through ePay;
         through PayPal
         with a debit/credit card;
         in another way indicated on the Ecofilter.store web page.

Delivery takes place after the authorization of the transaction, except when payment is made on receipt of the goods.

Phone confirmation

Art. 8. All products ordered through the Ecofilter.store website, which are in stock at the time of placing the order, will be delivered to the address specified by you (in the electronic request or by phone) within the terms specified below (Delivery Time) , which result from the receipt of an express confirmation of the order requested through the Site, provided by you personally by phone, to an employee of Ecofilter.store.

After pressing the "Send" button on the website, you will receive a letter with information about your order to the e-mail you have filled in your account. You should also expect a phone call from an Ecofilter.store employee, within 24 hours of placing the order, during business hours: Monday through Friday, 9:30 a.m. to 5:30 p.m.; Saturday and Sunday, from 10:00 a.m. to 4:30 p.m.

With this call, you will once again be expressly informed of the final sale price of the product ordered through the Site, including the exact cost of delivery, delivery times and availability of the product, in order to avoid any ambiguity or confusion.

Only after explicit confirmation of the order placed via the website, provided by you by phone, the contract for the purchase and sale of the product is considered concluded.

Cancellation of a requested order

Art. 9. During the telephone conversation with the Ecofilter.store employee who contacted you, you can cancel the order requested through the website by clearly and explicitly expressing your wish.

Opt-out can also be done before receiving the confirmation call, to an employee of the website at the specified customer service phone number.

Rights and obligations of the parties

Art. 10. Ecofilter.store undertakes:

     - to transfer to the Customer the ownership of the goods requested for purchase by him;
     - to deliver the goods requested for purchase on time;
     - to take due care in fulfilling his duties.

Art. 11. The customer undertakes:
         - to indicate an accurate and valid phone number and delivery address;
         - to pay the price of the goods;
         - to pay the delivery costs;
         - to ensure access and possibility to receive the goods;
         - to accept the delivery;

The customer shall:
         - not to submit fictitious requests or other information;
         - to comply with Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, Internet ethics, rules of morality and good manners;
         - not to violate someone else's property or non-property rights;
         - not to impersonate another person or a representative of a legal entity or a group of people that he is not authorized to represent, or otherwise mislead third parties about his identity or his belonging to a certain group of people.

Delivery

Art. 12. The goods requested for purchase are delivered to the delivery address specified by the Customer within the time specified on the web page, as a general delivery time.

The delivery term under para. 1 begins to run from the first working day after the authorization of the payment and after the explicit confirmation by the Customer in the manner indicated above. (Confirmation by phone)

The goods are delivered discreetly packed according to their type and the transport for delivery.

Delivery time

Art. 13. If the product is available at the time of placing the order, the delivery to the territory of Bulgaria will be carried out within 2 working days, counting from the receipt of explicit confirmation by the Customer, in the above-mentioned manner (Confirmation by telephone) .

Delivery is made by courier to the address specified by the Customer. Delivery to addresses outside the territory of the Republic of Bulgaria is carried out after additional clarification with a courier company of the deadline for delivery to the address specified by the Customer and authorization of all costs for the acquisition and.

Out of stock product

Art. 14. It is possible that the product you requested is out of stock at the time of placing the order. In such a case, the Customer will receive a phone call, no later than the end of the next working day, with specific information from an Ecofilter.store employee about the possible necessary extension of the delivery period or, if the product is completely out of stock, with the possibility to cancel immediately from the requested order.

Delivery of the goods

Art. 15. The goods are delivered to the Customer or to another person located at the delivery address indicated by the customer. The recipient confirms with his signature the receipt of the goods on behalf of the Customer.

When handing over the goods, the Customer or the person under para. 1 sign the accompanying documents.

In the case of refusal other than the cases under Art. 16, item 1, the refusal is considered unfounded and the Customer must pay the costs of returning the goods. In this case, the Customer is obliged to indemnify Ecofilter.store for all damages and lost profits, including any other costs beyond the costs of delivery and return of the goods, incurred as a result of the refusal.

In the event that the Customer is not found within the deadline for delivery to the specified address or access and conditions for delivery of the goods are not provided within this period, Eecofilter.store is released from its obligation to deliver the goods requested for purchase. The customer can confirm his desire to receive the goods after the expiry of the delivery period in which he was not found at the address, bearing all additional costs of delivery. In this case, a new delivery period starts from the moment of the confirmation according to the previous sentence.

Return of goods

Art. 16. The customer has the right to refuse to receive the goods he requested for purchase when they are delivered to him under one of the following conditions:
     A) the delivered goods clearly do not correspond to the ones requested for purchase by the Customer, and this can be established by a simple examination of them;
     B) the product or its packaging is damaged during transportation.

After receiving the goods, the Customer has the right to request its return if there is a significant defect that could not be detected during a simple inspection of the same.

Under the conditions of para. 1, item A, as well as in the event of a discrepancy between the requested purchase and the delivered goods, which could not be established at the time of delivery, the Customer may request that the delivered goods be replaced with those corresponding to the purchase application made by him within 24 hours of receiving it.

In the event that the Customer is not satisfied with the delivered products that he has purchased from the Ecofilter.store electronic store, he may, without giving a specific reason, within 14 calendar days of receiving the delivery, withdraw from the concluded contract and return the purchased products in the form (in quantity or quality, including the gifts received for them) in which they were delivered and we will refund the amount paid by the Customer within a period not later than 14 calendar days from the exercise of this right by the Customer. The customer must return the goods at his own expense with the same forwarder.

In order to exercise his right of withdrawal, the Customer can expressly notify us of this in a way convenient for him (for example, by letter sent by post, fax or e-mail, telephone, etc.).

It is also necessary to present/send us an original or a copy of the receipt or invoice issued when the product was purchased. Upon the Customer's order, the final sales price will be refunded to him by bank transfer to the account indicated by the Customer.

The customer cannot exercise his right of withdrawal in the case that he has used the goods or in the case that the goods have been unsealed and cannot be returned due to health / hygiene reasons.

Refusal of the sale is also not accepted for goods that are made to order or according to the customer's individual preferences; of goods with a short expiration date, as well as in other cases under Art. 57 of the Civil Code.

Ecofilter.store is not responsible for invalid or incorrectly filled personal data, address, bank account number and/or any other information provided by the Customer through the website or to an Ecofilter.store employee.

Personal data

Art. 17. Ecofilter.store takes due care to protect the Customer's personal data, which became known when filling out the electronic form for making a purchase application. This obligation lapses if the Customer has provided incorrect data.

In compliance with the current legislation and the clauses of these General Terms and Conditions, Ecofilter.store can use the Customer's personal data solely and only for the purposes provided for in the contract.

Ecofilter.store has the right to use the information under para. 1 for the offer of goods and/or services to the Customer, for promotions, for statistical and any other lawful purposes, except in case of express disagreement of the same, sent to the following e-mail address: sales@ecofilter.store

The above-described purposes for which the data may be used are not exhaustively listed and do not give rise to obligations for Ecofilter.store. Any other purposes for which the data is used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good manners.

Disclosure of information

Art. 18. Ecofilter.store undertakes not to disclose any personal data about the Customer to third parties - government bodies, commercial companies, individuals and others, except in cases where:

     - has received the express consent of the Client;
     - the information is requested by state bodies or officials who, according to the current legislation, are authorized to request and collect such information;
     - Ecofilter.store is required to provide the information by law.

Cancellation of contract

Art. 19. Apart from the cases specified above in these General Terms and Conditions, each of the parties may cancel the individual contract with a written notice by e-mail.

Responsibility

Art. 20. Ecofilter.store is not responsible for failure to fulfill its obligations under this contract in the event of circumstances beyond Ecofilter.store's control - cases of force majeure, random events, problems in the global Internet network and in the provision of services beyond Ecofilter's control .store.

Benefits

Art. 21. The customer is obliged to indemnify Ecofilter.store and all third parties for all damages suffered and lost benefits, including for any costs and attorneys' fees paid, incurred as a result of claims brought by and/or compensation paid to third parties in connection with failure to fulfill his obligations under this contract, violation of Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, good manners or Internet ethics.

Arbitration

Art. 22. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes arising out of or relating to the contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, and disputes to fill gaps in the contract or its adaptation to newly arising circumstances, will be resolved by the Court of Arbitration at the BCCI, in accordance with its Rules for cases based on arbitration agreements.

Invalidity

Art. 23. The parties declare that in the event that any of the clauses under these General Terms and Conditions prove/turn out to be invalid, this will not invalidate the contract, other clauses or its parts. The invalid clause will be superseded by the mandatory rules of law or established practice.

Intellectual property rights

Art. 24. All intellectual property rights on the elements of the "e-store www.ecofilter.store" belong to Ecofilter.store, including but not limited to: texts, graphics, computer programs, databases, etc. similar.

Applicable law

Art. 25. The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not settled by these General Terms and Conditions.
